We invited Nick and Yumi to learn and discuss inventive steps in UPC. The first thing we learned was how excellent Nick's presentation was. The way he spoke slowly and clearly while checking the audience's understanding was a model speech for Toastmasters. Since the law on which the UPC is based is not only the EPC but also national laws, there appears to be a step in determining inventive step in a case we discussed that seems to be different from the EPO's examination and opposition. We need to keep an eye on the accumulation of future court precedents.
NickとYumiさんをお招きして、UPCにおける進歩性について学び、議論しました。最初の学びは、Nickさんのプレゼンテーションのうまさです。聞き手の理解度を確認しながら、ゆっくりとわかりやすくに進める話し方は、トーストマスターズの模範のようなスピーチでした。UPCが基礎とする法律は、EPCだけではなく国内法もあることから、私たちが議論したケースではEPOの審査や異議とは異なるように思われる進歩性の判断ステップが見られたようです。今後の裁判例の蓄積に注目する必要があります。
