We invited Tim Hargreaves, Partner and Yumiko Kato, Senior Associate of Marks&Clerk for the special program this Thursday. Not many of us seriously doubt effectiveness of 20 years of patent term maybe just because it is a gigantic issue. This session was well designed by the lecturers so that all attendees could have interactive discussion without much preparation. There are many ideas for optimizing the term. For example, the term should run from the first market date instead of the filing date. But, an issue of "legal certainty" almost always gets in the discussion. As a matter of course, we did not reach any conclusions. But we enjoyed the discussion and learned that legal discussion requires more training.
