When one thinks about resolving disputes, bringing the case before the court would quickly come to one's mind. According to Ken Korea, founder of Colev Law and former Senior Vice President at Samsung Electronics as the head of the Silicon Valley IP, there are other options, namely arbitration and mediation. Starting from why interoperability matters, based on his practical experiences, Ken explained what SEP and FRAND are and showed how one can resolve globalized SEP/FRAND disputes by arbitration or mediation. This session gave a great opportunity to clearly understand nature and characteristics of SEP/FRAND disputes as well as how arbitration and mediation compliment the needs of businesses to swiftly settle the disputes with coherence and without incurring too much cost.
